Terms and conditions of the Pakowanko.com online shop

These terms and conditions define, among other things, the rules for concluding sales contracts through the shop, and contain the most important information about the seller, the shop and consumer rights.

The Pakowanko.com online store, available at www.pakowanko.com, is operated by PAKOWANKO Sp. z o.o., ul. Świerkowa 5, 41-706 Ruda Śląska, Poland, NIP: 7792529032, REGON: 389567254, KRS: 0000914342

§1 DEFINITIONS

The terms used in the Terms and Conditions have the following meanings:

  1. Buyer – a natural person, legal person or organisational unit that is not a legal person, to which specific provisions have granted legal capacity, who places an Order in the Store.
  2. Civil Code - Act of 23 April 1964 (Journal of Laws of 1964, No. 16, item 93, as amended).
  3. Terms and Conditions - these Terms and Conditions for the provision of electronic services within the online shop www.pakowanko.com.
  4. Online Store pakowanko.com - website available at www.pakowanko.com, through which the Customer may, in particular, place Orders;
  5. Goods - products presented in the Online Store.
  6. Purchase Agreement - an agreement for the sale of Goods within the meaning of the Civil Code, concluded between PAKOWANKO Sp. z o.o. and the Customer, concluded via the Store's Website.
  7. Consumer Rights Act - the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827, as amended).
  8. Order - the Customer's expression of will, aimed directly at concluding a Purchase Agreement, specifying in particular the type and quantity of Goods.

§2 GENERAL PROVISIONS

  1. These Terms and Conditions define the rules for using the Online Store available at www.pakowanko.com.
  2. The online store available at www.pakowanko.com is operated by PAKOWANKO Sp. z o.o., ul. Świerkowa 5, 41-706 Ruda Śląska, Poland, NIP: 7792529032, REGON: 389567254, KRS: 0000914342§1
  3. These Terms and Conditions specify in particular
    (a) the rules for registering and using an account in the online store
    (b) the conditions for electronic reservation of goods available in the Online Store
    (c) the conditions for placing Orders electronically within the Online Store
    (d) the rules for concluding Sales Agreements and Purchase Agreements using the services provided within the Online Store.

§3 RULES FOR USING THE ONLINE STORE

  1. The purchase of a Product does not require registration in the Online Store.
  2. The information provided on the Online Store's website, including information about the Products presented, in particular their description, technical and functional parameters, and prices, constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.
  3. Orders are placed using the form available on the Shop's website.
  4. Each Customer who registers and/or places an order agrees to receive information related to the transaction and notifications about changes to these Terms and Conditions to the e-mail address provided by them.
  5. In order to ensure the security of communication and data in connection with the services provided on the Website, the Online Shop takes technical and organisational measures corresponding to the level of security risk of the services provided, in particular measures to prevent unauthorised persons from obtaining and modifying personal data transmitted over the Internet.

§4 PROCEDURE FOR CONCLUDING A SALES AGREEMENT

  1. In order to perform any activities of the Buyer in the Store, it is necessary to have a properly functioning Internet connection, use a web browser, including on mobile devices, and have an active account at the selected e-mail address.
  2. In order to conclude a purchase-sale Agreement via the Online Store, visit the website www.pakowanko.com, make your selection and follow the technical steps based on the messages displayed to the Customer and the information available on the website.
  3. The Online Store allows you to purchase Goods and Services 24 hours a day, 7 days a week.
  4. The Customer selects the ordered Goods by adding them to the basket.
  5. When placing an Order, until the "Checkout" button is clicked, the Buyer has the option to change the data entered and the selection of Goods. To do this, follow the messages displayed on the screen and the information available on the website.
  6. In order to finalise the order, the Customer is asked to provide all the necessary data required to complete the order, i.e.
    a) first and last name/company name
    b) delivery address
    c) e-mail address
    d) contact
    telephone number e) VAT number - if a VAT invoice is requested.
  7. After the Buyer has provided all the required data in the Online Store, a summary of the Order is displayed. The summary of the Order placed contains information regarding
    (a) the subject of the Order
    b) the unit price and total price of the goods or services ordered, including delivery costs and any additional costs
    c) the selected payment method
    d) the selected delivery method.
  8. In order to place an Order, it is necessary to accept the Terms and Conditions, provide the personal data marked as mandatory and click the "Proceed to checkout" button.
  9. By sending an Order, the Customer declares their intention to conclude a purchase-sale Agreement with PAKOWANKO Sp. z o.o., in accordance with the Terms and Conditions.
  10. After placing and paying for the Order, the Customer receives an e-mail entitled "Order Confirmation", which contains the final confirmation of all essential elements of the Order.
  11. The Agreement is considered concluded upon receipt by the Customer of the e-mail referred to above.
  12. The sales contract is concluded in Polish, with content consistent with the Terms and Conditions.

§5 DELIVERY

  1. The prices of products in the Shop are given in Polish zlotys and include tax, but do not include delivery costs. Delivery costs are added to the amount of the ordered goods and are borne by the Customer. The final price binding on the Owner and the Customer is the price of the goods indicated at the time of placing the order by the Customer.
    Types of delivery and prices:
    a) GLS: PLN 20 gross/delivery time 1-2 working days
    a) GLS:
    PLN 24 gross/delivery time 1-2 working days
    b) GLS Cash on delivery: PLN 29 gross/delivery time 1-2 working days
  2. Information on the total cost of the order (including shipping costs, which are described in detail in the "Shipping and Returns" tab) is available in the Order Summary on the product sales page and in the order confirmation.
  3. Goods are delivered both within the territory of the Republic of Poland and to European countries and some countries located on other continents, to the address indicated by the Customer when placing the Order.
  4. The delivery of the ordered Goods is carried out by courier.
  5. For orders delivered within the territory of the Republic of Poland, the delivery time is two working days, counted from the date of payment for the Order by the Customer. For orders delivered outside the territory of the Republic of Poland, the delivery time is indicated in the information about the form of delivery and the country of destination.
  6. Along with the shipment, the Customer receives a printout of the Order confirmation and specification, as well as proof of purchase. A VAT invoice may be issued at the Buyer's request.
  7. If the Customer chooses to pay by bank transfer or payment card, the order processing time is counted from the date on which the Seller's bank account or settlement account is credited.

§6 PRICES AND PAYMENT METHODS

  1. Product prices are given in Polish zlotys and include all components, including VAT2. The Customer may pay the price
    (a) by bank transfer to the bank account number 12 1050 1243 1000 0090 3254 3713;
    (b) via PayU, PayPal or Autopay;
    c) Available payment methods: Payment cards
    : Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro.
  2. If it is necessary to refund the funds for a transaction made by the customer with a payment card, the seller will refund the amount to the bank account assigned to the Ordering Party's payment card.

AutoPay S.A. is a provider of online payment services for fast transfers.

§7 WITHDRAWAL FROM THE AGREEMENT

  1. A customer who is a consumer within the meaning of Article 22 of the Civil Code is entitled, on the basis of the provisions of law, to - the right to withdraw from a distance contract without giving any reason, by submitting a relevant statement in writing or by e-mail to zamowienia@pakowanko.com within 14 days or by sending it to the address of PAKOWANKO Sp. z o.o. provided in these Terms and Conditions.
  2. In the event of withdrawal from a distance contract, the contract is considered void. What the parties have provided shall be returned unchanged. The return must take place immediately, no later than within 14 days. The purchased goods should be returned to the following address: PAKOWANKO Sp. z o.o.
  3. Goods returned by the Customer should be packaged in an appropriate manner to prevent damage during transport.
  4. In the event of withdrawal from this contract, the Seller shall refund the Buyer all payments received from them, including the costs of delivery (except for additional costs related to the method of delivery chosen by the Buyer other than the cheapest standard method of delivery offered by the Seller), immediately, no later than 14 days from the date of return of the goods. The refund will be made using the same payment methods as those used by the Customer in the original transaction, unless the parties agree otherwise.

§8 RETURN AND COMPLAINT POLICY IN THE ONLINE SHOP

  1. If the purchased goods do not comply with the terms of the contract or have physical defects, the Customer has the right to lodge a complaint on the basis of
    (a) the rules provided for in the Act of 27 July 2002 on specific terms and conditions of consumer sales and amendments to the Civil Code (Journal of Laws No. 141, item 1176, as amended), in the event of non-compliance of the goods with the terms of the contract
    b) on the terms specified in the provisions of the Civil Code regarding liability under the warranty for defects.
  2. In order to make a complaint, the Customer is obliged to notify the Shop by e-mail at zamowienia@pakowanko.com, and then follow the instructions received.
  3. When submitting a complaint in accordance with Article 1(a), the Buyer has the right to demand that the goods be brought into conformity with the contract by means of free repair or replacement with new goods, unless repair or replacement is impossible or would involve excessive costs. If the shop fails to satisfy these demands, the Buyer has the right to demand an appropriate price reduction or to withdraw from the contract.
  4. The Buyer has the right to withdraw from the contract or demand a price reduction by submitting a complaint in accordance with the procedure provided for in Article 1(1). The Buyer shall not have the right to withdraw from the contract if the Seller immediately, no later than within 14 days, replaces the defective goods with goods free from defects or immediately removes the defects. This restriction does not apply if the goods have already been replaced or repaired by the Shop, unless the defects are insignificant.
  5. The Shop is liable for non-compliance of consumer goods with the contract (Article 1(a)) only in cases and on terms provided for by law.
  6. The Shop is liable for defects in the goods on the basis of a warranty (Article 1(b)), in the cases and under the conditions provided for by law.
  7. The Shop shall consider complaints within 14 days of receiving the complaint form together with the complete set of goods subject to complaint.
  8. The Shop reserves the right to refuse to accept a complaint if the Buyer has made any changes to the goods.
  9. The Shop reserves the right to refuse to accept a complaint in the following cases: due to the sole fault of the user, mechanical damage, improper maintenance and use of the product contrary to the instructions.
  10. The costs of delivering the goods subject to complaint, if the complaint is accepted, will be refunded to the Customer within 14 days from the date of acceptance of the complaint.

§9 PRIVACY AND PERSONAL DATA PROTECTION POLICY

  1. In order to make a purchase in the Shop, the Customer must provide all the data required in the form and tick the appropriate box (checkbox) regarding the Customer's consent to the processing of their personal data by the Owner, as well as the box (checkbox) regarding confirmation of having read and accepted these Terms and Conditions.
  2. All Customer data provided during registration in the Store will be used solely for the purpose of performing, amending or terminating the Agreement or other marketing activities, in particular to inform about new products and services of the Store, provided that the Customer gives their consent by ticking the appropriate box (checkbox) for the sending of commercial information by electronic means within the meaning of the new Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016.
  3. All personal data of the Customer will be processed by the Owner in accordance with the above Act.

  5. Only personal data voluntarily provided by the Customer is collected. The data is processed for the purposes necessary to implement the provisions of these Terms and Conditions, in particular to conclude a contract for the sale of the ordered goods, to deliver the goods ordered by the Customer, to issue a document confirming the sale of the goods, to store personal data in the IT and accounting system in order to ensure the history of commercial transactions made through the Store.
  6. The data provided when placing an order is also processed by the following entities to the extent specified: name and surname, address, telephone number, e-mail address provided as the delivery address are forwarded to transport companies in the form of a transport label/waybill, which is also a delivery order for the goods. Depending on the type of shipment selected, the data is transferred to
    a) GLS-Polska
    b) DPD Polska Sp. z o.o.
  7. The data is also processed by entities involved in the payment for the order:
    (a) PayU S.A.
    (b) PayPal Polska Sp. z o.o.
    In such cases, the amount of data transferred is limited to the minimum necessary. In addition, the information provided by the User may be transferred to the competent public authorities if required by applicable law.
  8. The Data Controller is not responsible for the provision of false or incomplete personal data by the Customer.
  9. The Buyer has the right to change, correct or delete their personal data at any time through the Shop's customer service office.
  10. With the additional consent of the Buyer, the collected personal data may also be used for advertising and marketing purposes, including in particular to present the Buyer with the Shop's commercial offer and other marketing information related to the Shop.
  11. Each user has the option to subscribe to the newsletter - commercial information. Subscription to the newsletter is done by ticking the appropriate box in the form at the registration stage (only an email address is required). You can unsubscribe from the newsletter at any time by using the link provided in the newsletter or by notifying the Shop by email at info@pakowanko.com. After unsubscribing, your email address will be immediately removed from the subscription database.
  12. The Shop uses, among other things, so-called cookies, which contribute to the convenience, functionality and ease of use of our Shop. These tools also make it easier for customers to navigate the Shop's website more quickly. In addition, cookies allow us to measure the frequency of visits to the website and the most popular products. Cookies are small text files that are stored on the user's computer system. Please note that some of these files are transferred from the Shop's server to the Buyer's computer system. The user can block cookies at any time if the browser has the appropriate function. Please note that if cookies are blocked, the use of some of the Shop's functions will be significantly limited or impossible.

§10 FINAL PROVISIONS

  1. All content posted in the Shop is protected by law, and its use constitutes a violation of the law.
  2. In matters not covered by these Terms and Conditions, the provisions of Polish law shall apply, in particular the Civil Code and the provisions of the Act of 18 July 2002 on specific terms and conditions of consumer sales and amendments to the Civil Code (Journal of Laws of 2001, No. 144, item 1204), as well as the provisions of the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, No. 827, as amended); and other relevant provisions of generally applicable law.
