SUP DIRECTIVE – LEGAL UNCERTAINTIES

In recent years, plastic pollution has become one of the most serious environmental challenges in the world. In response to this issue, the European Union has adopted a directive on single-use plastic products (SUP) aimed at reducing the use of single-use plastic items. However, the implementation of this directive has caused some legal confusion, particularly in the context of catering packaging.

Pakowanko, a leader in the packaging industry, together with the Dla-ekologii.pl foundation, has taken steps to understand the legal consequences of the SUP Directive. In response to the changes in the regulations, they have submitted a request for a tax interpretation of the SUP Act in relation to single-use catering packaging.

The most pressing issue in relation to the SUP Directive is the change in the naming of disposable products to reusable products. Many manufacturers of single-use catering packaging were forced to adapt their products by changing their intended use to reusable. However, some of these changes were purely cosmetic, and the packaging itself remained intended for single use.

In addition, the issuance of declarations of conformity by manufacturers was not always relevant in the light of the law. Often, these were merely formalities that did not guarantee the actual compliance of the product with the requirements of the SUP Directive.

In the context of the actions taken by Pakowanko, it is worth noting that not all single-use packaging for the catering industry is subject to the SUP Act. There are certain exceptions and restrictions that may affect the application of the new regulations to specific products.

The request for a tax interpretation of the SUP Act aims to clarify these issues and understand the legal consequences for companies in the packaging industry.
